A Pennsylvania NFT trader faces up to six years in prison after pleading guilty to federal tax fraud charges for failing to report $13 million in profits from CryptoPunk NFT sales. Waylon Wilcox, 45, deliberately concealed 97 high-value NFT transactions over two years, evading approximately $3.3 million in taxes in what prosecutors describe as one of the first major U.S. cases involving NFT-related tax evasion.

Wilcox underreported income by $8.5 million in 2021 and $4.6 million in 2022 from CryptoPunk sales, selecting “no” when asked about cryptocurrency transactions on tax forms.

The IRS uncovered the fraud by tracing blockchain records and exchange data, demonstrating their improving ability to link crypto transactions to individuals.

The case coincides with intensified IRS focus on cryptocurrency tax compliance ahead of the April 15 deadline.

This prosecution could establish a precedent for how NFT profits are treated under tax law and the serious consequences of evasion.

The Fraud Scheme Details

Court documents reveal that Wilcox conducted 62 CryptoPunk sales in 2021, generating $7.4 million, and another 35 sales in 2022, generating $4.9 million. Despite these substantial profits, he falsely claimed on his tax forms to have no involvement with digital asset transactions.

This deliberate misrepresentation allowed Wilcox to underpay $2.1 million in taxes for 2021 and $1.1 million for 2022. The guilty plea was entered on April 9, 2025, with sentencing expected to include imprisonment, supervised release, and additional fines.

IRS Cryptocurrency Compliance Efforts

This case highlights the IRS’s increasingly sophisticated approach to tracking cryptocurrency transactions. The agency used blockchain analytics tools to trace Wilcox’s sales and match them to his identity, breaking through the perceived anonymity of crypto wallets.

He continued, “In today’s economic environment, it’s more important than ever that the American people feel confident that everyone is playing by the rules and paying the taxes they owe.”

The IRS issued guidance in 2023, specifically requiring NFT gain and loss reporting. Using a “look-through analysis,” the IRS will determine if an NFT is a collectible based on its associated asset. For example, NFTs tied to gems or art would be considered collectibles, subject to a higher tax rate of up to 28%. Public comments were solicited to refine this approach.

Impact on the NFT Market

Despite regulatory scrutiny and legal cases like Wilcox’s, the CryptoPunk collection continues to maintain significant market value. While trading volume has dropped approximately 70% from its 2021 peak, CryptoPunks remains the largest NFT collection with a floor price that has stabilized at around $68,000.

Trump’s trade policies have dominated headlines in recent weeks, with his most recent move being the levying of tariffs on virtually every country in the world. Trump himself has said it will bring manufacturing and economic prosperity back to the US. Proponents claim it will raise additional revenue for the government, but opponents say it will push prices up and that it is consumers who will ultimately pay the price, in the form of higher prices.

Cryptocurrency’s Role

Cryptocurrency is billed as being a hedge against market turbulence. The crypto markets also tend to prosper during times of high inflation. To benefit, users need to buy or exchange crypto using exchanges or directly from third parties, before storing their holdings. Users can also track their coin and token performance while being able to make payments quickly and seamlessly using the wallet.

What Trump Did

Trump has long declared himself a fan of tariffs. In January he said: “Tariffs are the most beautiful word to me” during his inauguration day speech. And, he has been true to his word, initially threatening and withdrawing tariffs against countries including Canada and Mexico, before eventually implementing levies. This week, Trump initiated baseline tariffs for virtually every country in the world, starting at 10%. Some countries have now been hit by cumulative tariffs as high as 50% or more.

The Effects So Far

So far, global stock markets have suffered substantial drops, while the US Dollar tanked on the announcement. Bitcoin, despite being considered a good investment in times of turbulence, also underwent price declines immediately following Trump’s announcement with prices falling around 4% in the 24 hours following the tariff launches.

The so-called reciprocal tariffs were announced on April 2, when Bitcoin was trading at around $87,000. Prices initially slumped to $82,500 and have ranged between $81,500 and $84,500 since. BTC’s price is currently around $83,000. While Bitcoin’s prices have dropped, they haven’t fared as badly as stock markets or even the US Dollar, in trading.

Looking beyond pure prices, the total market value has suffered. 24 hours after the tariffs were announced, total cryptocurrency market capitalization stood at $2.75 trillion, which was down 6% in the 24 hours.

Crypto Stock Prices

Crypto stocks also fell after the announcement. Coinbase dropped nearly 8% while mining companies MARA Holdings (8.3%), Riot Platforms (8.7%), and Bitfarms (5%) shed value, too. Miners may be some of the hardest hit, following these latest levies.

Most mining equipment is manufactured in and imported into the US from China, and China has been hit hardest by the new fees with a combined 54% now levied against products from the country. Taiwan and South Korea also produce some of the most highly sought-after mining chips, and these countries were hit with 32% and 25% tariffs respectively.

Trump On Crypto

Trump has previously promised to make the US the Bitcoin mining capital of the world, despite having previously described Bitcoin as a scam. His tariffs, however, seem to run counter to his latest crypto promises.

According to experts, the new charges will cause institutional investors, who are the ones with the deepest pockets, to move away from US-led companies. This means they will be more inclined to invest in crypto companies from other regions. And, despite promises made to his multi-billion dollar election campaign backers from the crypto market, Trump has not exactly been forthcoming with fine details.

There have been promises of Bitcoin strategic reserves, but other than stating that the US will no longer sell off seized cryptocurrency assets, no more information has been forthcoming, as yet.

The Start Of A Trade War

Trump’s reciprocal tariffs are not viewed as being reciprocal by the rest of the world. As such, many countries are already highlighting their own retaliatory tariffs and this looks like the beginning of a global trade war. A trade war will cause uncertainty in all markets, and, in the short term, most investors will likely move their investments to more secure, stable alternatives.

Bonds, and even cash, will become more popular in the coming months. In the long term, however, increased volatility in traditional stock markets may play in cryptocurrency’s favor. What’s more, if price rises are passed on to consumers, which seems highly likely, this will likely result in higher inflation. Bitcoin can enjoy price increases during inflation shock. However, as investors likely expect increases in inflation, there not be a shock.

Uncertainty Looms

In truth, few people are certain what will happen following the introduction of Trump’s tariffs. The move is unprecedented, and markets have never experienced anything quite like it. Trump himself believes that in the US at least, stocks will eventually boom. He believes that a reduction in trade deficits means more people will buy US goods, and this will lead to higher profits for US companies. In turn, workers will be paid more.

So far, the cryptocurrency market has responded similarly to stock markets and even financial markets, suggesting a degree of market maturity we haven’t really seen in web 3.0.

It seems highly likely that companies that rely heavily on Chinese imports, and import from other countries with high levies, will suffer, but this won’t necessarily carry over from stocks to crypto coins. Crypto could benefit in the long term, as investors look for ways to hedge against inflation through alternative investments.

Next Moves

Markets are likely to continue fluctuating in the coming weeks. The EU has suggested it will respond with tariffs on the US, set to launch in mid-April. Even the UK, which saw the lowest tariffs of all countries and has so far avoided threatening retaliatory measures, has drawn up a list of hundreds of US products that could be taxed if the two countries fail to come to a beneficial trade agreement.

Co-founder of Ethereum Layer 2 network Scroll, Haichen Shen, announced that the Euclid upgrade proposal has passed vote and will be rolled out over the next two weeks, aligning with the April 2025 governance cycle.

The upgrade includes several key changes aimed at enhancing the Scroll ecosystem’s overall performance and developer experience. These changes involve transitioning to the OpenVM Prover, adopting Merkle Patricia Trie (MPT) for state commitments, refining the rollup process, and integrating compatibility with Ethereum Improvement Proposal 7702 and RIP-7212. Additionally, the protocol will move toward Stage-1 readiness, which marks a milestone in technical maturity and stability. 

These improvements are anticipated to lead to lower transaction costs, increased processing capacity, enhanced security features, improved alignment with Ethereum standards, and broader functionality for both developers and users operating on the Scroll network.

Euclid Upgrade To Introduce OpenVM Prover, MPT State Commitment, And Other Features

Scroll has detailed the technical upgrades included in its Euclid release. One of the most important  changes involves the migration to the OpenVM Prover. Previously, Scroll relied on halo2 zkEVM circuits for zero-knowledge proof (ZKP) generation. However, as zero-knowledge (ZK) technology has fast matured, general-purpose RISC-V ZK virtual machines have become more viable. With the Euclid upgrade, Scroll is moving away from halo2 to adopt a new prover built on OpenVM. This transition is expected to simplify the architecture, making the prover code more accessible for review and auditing. It also improves modularity across system components and reduces latency and proving costs. Additionally, OpenVM enables the network to support more complex transactions by removing the need for a circuit capacity checker, which had previously limited sequencer throughput.

Another major change is the replacement of Scroll’s current state commitment structure, zktrie, with Ethereum’s native Merkle-Patricia Trie (MPT). This switch is made feasible by the OpenVM Prover’s capabilities and offers more seamless compatibility with existing Ethereum applications that rely on Layer 2 state proofs. The adoption of MPT is also expected to improve sequencer efficiency and overall system interoperability.

The rollup process itself is being optimized through several backend improvements that collectively reduce the overhead associated with data availability. These optimizations include integrating blob verification directly into ZK circuits, consolidating message queue commitments, relocating block header data to more efficient blob storage, and allowing multiple blobs to be committed in a single transaction. These enhancements are projected to cut the cost of batch commitments by as much as 90%. Additionally, Scroll will phase out the existing Clique Proof-of-Authority consensus and transition to using a new SystemConfig contract on Ethereum Layer 1 to manage authorized block signers.

Support for advanced smart account features is also being introduced with the adoption of Ethereum’s EIP-7702 and RIP-7212. These upgrades coincide with Ethereum’s upcoming Pectra update and ensure compatibility with the broader ecosystem. They allow users to integrate smart contract logic into their accounts, utilize passkeys for authentication, and benefit from user experience improvements tied to these newer standards.

Finally, Euclid brings Scroll closer to meeting the Stage-1 security criteria defined by L2BEAT. Two critical safety mechanisms are being introduced: enforced transaction inclusion and permissionless batch submission. The first allows users to submit transactions directly from Ethereum, ensuring that they are included even if the sequencer is unresponsive. The second provides a fallback by enabling anyone to submit and finalize batches if the sequencer fails to do so. These protections are intended to safeguard network reliability and user autonomy by reducing the risk of censorship and ensuring continued liveness.

Scroll is designed as a Layer 2 solution for Ethereum that emphasizes both security and scalability. Building on Ethereum’s foundational infrastructure, it integrates ZKP technology to introduce a more efficient execution layer. The primary goal of this additional layer is to enhance the overall performance of the network by improving user accessibility and responsiveness, while also increasing the number of users and transactions the system can handle concurrently—surpassing what Ethereum’s base layer can support on its own.
